GENERAL TERMS AND CONDITIONS OF ONLINE SALES OF VISIT TICKETS AND TASTING WORKSHOPS
Applicable from 30th March 2024
ARTICLE 1 – SCOPE OF APPLICATION
The Internet website available at www.nicolas-feuillatte.com (hereinafter ‘the Site’) is an online sales website edited by TERROIRS ET VIGNERONS DE CHAMPAGNE (hereinafter ‘TEVC’ or ‘the Seller’). These general terms and conditions govern the sales of tickets permitting the visit of TEVC’s production site (hereinafter the ‘GTC’). TEVC is an Agricultural Cooperatives Union, listed on the Reims Trade and Company Register under the number 775 611 924, whose registered office is located at CD 40 A “Plumecoq” 51530 Chouilly.
These GTC define the respective rights and obligations of TEVC and its Clients (as this term is defined hereinafter), in the context of the online sale of tickets permitting the visit of TEVC’s production site as well as the tasting workshop given at TEVC’s store in Paris (hereinafter ‘the Visit’ and ‘the Tasting Workshop’ or collectively ‘the Service’), in accordance with the terms and conditions of the price list available on the Site. The offers on the Site are strictly reserved for natural persons of legal age and with full legal capacity to order on the Site (hereinafter ‘the Client’). The Client is a consumer, which means that he is acting for purposes that are not related to his commercial, industrial, craft or liberal activity. Clients who are "legal entities" are invited to contact the Seller's Hospitality Department. Legal entities refer to the State, French Departments, municipalities, public institutions, certified associations, commercial companies and foundations.
Any order made on this Site implies the prior and unconditional approval of the present GTC by the Client. This approval is materialized by the notch of the mention "By validating your subscription, you declare to have read and accepted without reserve the General Terms and Conditions of Sale, Legal Notice and Personal Data Policy" at the time of the creation of a Client Account (defined below).
The GTC applicable to the order are those in force on the day of the confirmation of the order on the Site. However, the GTC are likely to be modified and updated by TEVC at any time and without notice. It is the Client’s sole responsibility to read the GTC carefully when making each order.
ARTICLE 2- DESCRIPTION OF THE SERVICE
2.1 Individual Visit of the production site
The Client will visit TEVC’s production site. A guide will comment on the Tour. The duration of the Tour is given as an indication only, and TEVC reserves the right to shorten the Tour particularly in the event of force majeure (as defined below) or in the event of delay due to the Client in order to take into account the organization of the subsequent Tours. Any delay over ten (10) minutes due to the Client may result in the cancellation of the Visit.
In the event of delay, the Visit will be shortened, without justifying any reduction in price or refund to the client.
2.2 Group Visit of the production site
All group bookings for groups larger than twenty (20) persons (hereinafter the ‘Group’) are eligible for special arrangement, including special rates. The format of the Visit is the same as the individual Visit as set out in the article above.
To ensure the safety of the Group, groups larger than thirty (30) persons will be accompanied by two (2) guides.
For all group visit bookings, the Client must contact the Hospitality Department, as defined in Article 13 herein.
2.3 Visit with tasting
Tastings provided by TEVC comply with the following standards:
Service sample of 10cl, spittoons provided, and breathalyzer tests provided on request.
In accordance with article L 3342-1 of the Code of Public Health in France, Visits offered by TEVC do not serve alcohol to minors.
TEVC reserves the right to refuse to serve alcohol to any person considered to be under the influence of alcohol.
ARTICLE 3 – ODERING SERVICES
3.1 Creation of the Client Account
The placing of any order through the Site requires that the Client has first created a client account (hereinafter defined as ‘the Client Account’). The creation of a Client Account may be carried out independently of any order or prior to the validation of an order.
To create a Client Account, the Client must fill in the form provided. This form contains "mandatory" information as it is necessary for the identification of the Client (title, first name, last name, invoicing address, telephone number, passwords, email address, country…). Mandatory information are indicated by an asterisk (*) on the Site. This form also includes "optional" information that the Client is not obliged to fill in to place an order on the Site (information not marked with an asterisk). After registration, the Client will receive an automatic e-mail confirming the creation of his Client Account.
It is specified that the password created by the Client is personal and confidential. It must be complex enough to protect the account. In case of forgotten password, the Client will be able to request a new password by clicking on the "Forgot your password? " from the login form.
The information thus communicated shall be complete, accurate and up-to-date. The Seller reserves the right to ask the Client for confirmation (by any method) of the information he/she provides and of his/her identity.
3.2. Placing an order
The Client must ensure that he has the necessary software and hardware configuration to purchase and print the Ticket for the Service.
To place an order on the Site, the Client has to follow the procedure below:
1. Select the Service he wishes to order and enter the quantity.
2. Select the date and time and click on “NEXT”.
3. Then the Client is asked to identify himself with his Client Account by entering his e-mail address and password. If the Client does not have a Client Account, the Client is invited to create one.
4. On the "order overview" page, the Client can:
- Add/remove items to his cart.
- Enter their "gift coupon" code if he has one.
- See the summary of his cart, including the promotions applied.
The Client then has the choice to continue his purchases or to complete his order.
To confirm the order, the Client must accept these terms and conditions by clicking on the "I accept the terms and conditions of sale" box and click on "NEXT".
The Client must select the payment method.
To definitively confirm his order and pay, the Client clicks on "Pay". The Client is then redirected to the transaction platform of the payment provider where he indicates his banking information and confirms his payment.
Once the Client has validated and paid for his order, he is automatically redirected to a page of the Site on which the Seller confirms his order. At the same time, the Client receives (i) an e-mail from the Seller acknowledging receipt of the order, providing an order number and a summary of the order, (ii) a payment confirmation e-mail from the payment provider, (iii) an e-mail containing the selected Services.
Any order that has not been validated will not be honored. The simple fact of adding a Service to the cart does not constitute validation of the order.
The Seller may ask the Client to provide proof of identity. In this case, the order will only be confirmed upon the receipt and the validation of such documents. The accepted proof of identity is the following: a national identity card, a passport, a driving license.
Each Service present a unique bar code. The validity of the Service is checked at the entrance with the help of bar codes readers. The Service is personal and non-transferable and must be kept until the end of the Visit.
The Services received by e-mail must be printed on white A4 paper, with the bar code and the mentions clearly printed. The Client may also download these Services on a cell phone. The Service is only valid for the day and the date indicated on it.
Regardless the method of payment chosen, the Seller reserves the right to refuse any order in the event of (i) refusal of authorization of payment by the banking organization or (ii) non-payment, total or partial, of a previous order made by the Client.
The sale will be considered concluded only after the receipt by TEVC of the whole price.
Failure by the Seller to confirm an order shall not be considered as a confirmation and acceptance of the order.
For all group tour bookings, the Client must contact the Hospitality Department, as defined in Article 13 below.
3.3 Order cancellation / amendments
The Sale Services shall be assimilated to a sale of leisure services in accordance with article L221-28-12° of the French Code de la Consommation, and thus, cannot give rise to any withdrawal right.
Any ticket sold and paid by the Client cannot not be amended, exchanged nor refunded except in case of cancellation by TEVC.
In such case, TEVC shall inform the Client thereof, in writing or by phone at contact address or numbers provided by the Client on the registration form, as soon as it has learnt of any event that may entirely of partially affect the Services and will try to reach a satisfactory compromise with the Client for all parties concerned.
If TEVC and the Client do not manage to reach an agreement for another date or another site for the Services, TEVC undertakes to return to the Client all payments collected from the latter under the contract in question. The refund is exercised with the same payment methods as used by the Client for the order.
In the event of governmental measures related to the occurrence of a Pandemic, the Parties have the option to cancel the Visit. In such event, the Seller undertakes to refund to the Client all sums paid, unless the Visit is postponed to a later date. The Client shall not be entitled to any additional compensation.
3.4 Refusal of the order
The Seller reserves the right to refuse any order from a Client who does not comply with the provisions of the GTC and/or the legislative and regulatory provisions in force in France or in the Client's country.
The Seller also reserves the right to refuse access to the Services and more generally to TEVC site to any person deemed likely to present a danger to himself or to others, as well as to the property of TEVC or third parties.
ARTICLE 4 – PRICE AND METHODS OF PAYMENT
4.1 Visit prices of the production site
Costs of Visits to TEVC, valid from 30th March 2024, are set out below:
- Individual Visits:
- Visit and Tasting (1 glass of Champagne): seventeen euros (17 €)
- Visit and Tasting (2 glasses of Champagne): twenty- two euros (22 €)
- Visit and Tasting (3 glasses of Champagne): twenty-seven euros (27 €)
- Visit and Blind tasting (3 glasses of Champagne): sixty euros (60 €)
- Visit and Package « En route » (pick-up and dropp-off Epernay / TEVC) and Tasting (3 glasses of Champagne): fifty-seven euros (57 €)
Child Visit (10-18 years old): ten euros (10€)
Child Visit under 12 years old: Free
For all group bookings, the Client must contact the Hospitality Department, as defined in Article 13 below.
4.2 Prices of tasting workshop at TEVC’s store in Paris
Costs of Tasting at TEVC’s store in Paris, valid from 30th March 2024, are set out below:
- Tasting of 3 glasses of Champagne – L’Essentielle: twenty euros (20 €)
- Tasting of 3 glasses of Champagne – Le Terroir: twenty-five euros (25 €)
- Tasting of 3 glasses of Champagne – La Prestige: thirty euros (30 €)
4.3 It is illegal to sell or supply alcohol to anyone under the age of 18 in France. By placing an order or making a purchase from TEVC the Client confirms he/she is 18 or older. TEVC reserves the right to request a proof of the Client’s age at any time.
All prices indicated are per person and include VAT (applicable at 20%). The rate applicable is the rate in force on the day the Client places the order.
The Seller does not provide transportation services for persons, except for the Package « En route » (pick-up and drop-off Gare d’Epernay / TEVC). The transportation remains at the charge and under the sole and entire responsibility of the Client. As a result, no compensation will be due to the Client if he cannot attend the Services on the agreed dates.
At no time, the sums collected can be considered as a deposit or advance payment.
In accordance with the applicable regulations, the Seller reserves the right to modify its prices at any time and without notice.
4.4 Invoicing
A detailed invoice will be established for each order. It will be available in the "My Orders" section on the Client Account. The Client has the option to download and/or print the invoice.
4.5 Methods of payment
The Client has the possibility to use the following payment cards: Visa / MasterCard / Blue Card (including American Express).
The Client must be the holder of the card used. The Client will be automatically redirected to the transaction platform of the banking organization which provides the payment service Payzen. The banking information is entered via a secure server that guarantees the security and confidentiality of the information provided by the Client during the banking transaction.
The order will be processed the day after the Payzen transfer is received.
It is expressly agreed that payment methods other than those listed above (checks, cash, etc.) will not be accepted.
ARTICLE 5 – LIABILITY
Alcohol consumption in excess may be damaging to your health. TEVC informs Visitors that tastings are carried out entirely at their own risk. TEVC accept no responsibility for any injuries or loss incurred to Visitors during the Services, either as a result of consuming alcohol as part of the Visit, or food intolerance.
TEVC may not be held liable for its failure to fulfil or the incorrect fulfillment of its obligations under the GTC if that failure is attributable to the Client, in particular if the instructions given by the Guide are not respected, or to an unforeseeable or insurmountable event due to a third party to the contract, or to a case of force majeure.
We accept no responsibility for the theft, loss or damage to personal belongings at any time during the duration of the Services.
ARTICLE 6 - SAFETY
TEVC is an industrial wine production site and is therefore subject to strict safety regulations. Clients must accept these safety regulations and they will be informed of these regulations during the Visit. Clients must agree to remain strictly on routes set out for the purposes of the Visit, respect indications regarding circulation on site, and all instructions provided by the Guide. Failure to do so may lead to the immediate cancellation of the Visit.
During the Services, the Client must respect the instructions provided by the Guide and follow the shielding measures.
Pets are not allowed on site.
ARTICLE 7 – INTELLECTUAL PROPERTY
The entire Site is regulated by French and international legislations on copyrights and intellectual property.
All rights related to intellectual property and databases of the Site and the materials published on it, including, without limitation, trademarks, designs, logos, texts, images, photographs, audio and video materials is - unless otherwise stated - the exclusive property of TEVC.
Any representation, reproduction, retranscription, distribution, modification, adaptation, imitation, partial or total use of the contents of the Site, for any public, commercial, political or advertising use, by any process, is strictly forbidden without the prior express written consent of TEVC and engages the responsibility of its author. For information, acts of copyright infringement are punishable in France by 3 years of imprisonment and a fine of 300,000 euros (art. L 335-2 and following of the French Intellectual Property Code).
The Client may download or print certain contents of the Site, provided that (i) such contents are intended solely for private and personal use, (ii) no copyright or other property rights are removed from such contents, (iii) the downloaded or printed contents are not modified, (iv) the Client is in a country in which the consumption and/or purchase of alcoholic beverages is permitted, (v) the Client is of the minimum legal age required for the consumption and/or purchase of alcoholic beverages in the country in which he/she is located.
ARTICLE 8 – PERSONAL DATA
All personal data concerning the Client submitted during the use of the Site, including personal data collected during any subscription or order process, are subject to the Site's Privacy Policy, which is an integral part of these GTC and which is available here or from a link provided at the bottom of each page of the Site.
The Seller invites the Client to regularly consult the Privacy Policy, in order to be aware of any changes made to it.
ARTICLE 9 - FORCE MAJEURE
Any act of force majeure as defined by article 1218 of French Civil Law, notably any external, unforeseeable, and unavoidable event, which may lead to the cancellation or postponement of the Visit by TEVC. This may include the exceptional or sudden closure of the Visit, exceptional safety measures (i.e. fire alarm).
TEVC shall not be liable or responsible for any failure to perform, or delay in performance of any of its obligations under a Contract that is caused by events outside our reasonable control (force majeure event).
ARTICLE 10 - PROOF, STORAGE AND ARCHIVAL OF TRANSACTIONS
The Seller implements every measure to ensure the confidentiality and the security of data transmitted on the Site. The computerized registers, kept in the IT systems of the Seller, in reasonable conditions of security, will be considered as proof of communications, orders, payments and transactions between the Parties, unless proven otherwise.
Invoices are archived on a reliable and durable support, in accordance with the legal provisions.
ARTICLE 11 – NON-WAIVER
The fact that TEVC does not prevail at a given time of any of the provisions of the GTC shall not be interpreted as a withdrawal by TEVC to prevail at a later date.
ARTICLE 12 – DISPUTES – APPLICABLE LAW
12.1. Governing Law and Contract language
The present GTC of sales are exclusively governed by French Law.
The GTC have been written in French and a translation is available in English.
In case of divergence of interpretation between the French version of the present GTC of sales and a version in another language, the version in French language shall prevail.
12.2. Assignment of jurisdiction
In the absence of an amicable agreement between the parties, any dispute arising from the formation, interpretation or execution of these GTC or any order, will be subject to the jurisdiction of the Commercial Court of Reims (Marne, 51), France.
